VOW Terms of Use

These Terms of Use (version 2026-11-03.2) form an agreement between you and REMAX ELEVATE, Brokerage, 6-9889 Markham Rd., Markham, ON L6E 0B7, 905-940-2222 (“the Brokerage”, “we”), the operator of this Virtual Office Website (“VOW”) at www.remaxelevate.com. You must read and accept them before we show you sold, leased or other MLS® information that is only available to registered users.

1. Registration

To register you must give your real name and a valid email address that belongs to you. Access starts only after we have verified your email address (by sending you a confirmation link) and you have accepted these Terms of Use. Your username is your email address, and you create your own password; each email address can be used for only one account. Your account is for you alone: do not share your password or sign-in links with anyone. Your password is valid for no more than 90 days; after that you must set a new password and reconfirm these terms before we show sold or leased information again.

2. What you agree to (PropTx MLS® Rule 8.09)

By clicking to accept these Terms of Use, you expressly agree that:

1. you are entering into a lawful broker–consumer relationship with REMAX ELEVATE, Brokerage;
2. all MLS® listing information you obtain from this VOW is for your personal, non-commercial use only;
3. you have a bona fide interest in the purchase, sale or lease of real estate of the type being offered through this VOW;
4. you will not copy, redistribute, retransmit or otherwise use any of the data or listing information you obtain from this VOW, except in connection with your consideration of the purchase, sale or lease of an individual property, and you will not run it through or use it with any artificial intelligence (AI), machine-learning or similar analysis tool;
5. you will not display, distribute, sell, license or sublicense any of the listing information to any other person or entity, including any artificial intelligence (AI) system or service;
6. you will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell or sublicense any listing information to any other person or entity, and you will not use it for “scraping” (including screen scraping and database scraping), “data mining”, framing, bulk downloading or any other activity intended to collect, store, re-organize, summarize or manipulate listing information or any related data;
7. you are not a real estate salesperson, broker or brokerage employee using this VOW for a commercial purpose, and you will not use it for any commercial purpose; and
8. you acknowledge PropTx Innovations Inc.’s ownership of, and the validity of its proprietary rights and copyright in, the MLS® database, the MLS® data, the PropTx MLS® System and the listing information (with the Toronto Regional Real Estate Board, TRREB).

3. No agency or financial obligation (Rule 8.10)

Accepting these Terms of Use does not create an agency or representation agreement and does not impose any financial obligation on you. Any agreement that does (for example a Buyer Representation Agreement or a Listing Agreement) will be a separate document, prominently labelled as such, and will not be accepted solely by a mouse click on this website.

4. Compliance access (Rule 8.11)

You agree that TRREB, PropTx Innovations Inc. and other MLS® members, and their authorized representatives, may access this VOW to verify compliance with the MLS® rules and policies and to monitor the display of listings.

5. Your account

Your account is tied to one email address and is for your use only. Do not share it or your sign-in links. Your access expires and must be renewed at least every 90 days.

6. Accuracy

The information is deemed reliable but is not guaranteed accurate by PropTx, TRREB or the Brokerage, and should be independently verified. The trademarks MLS®, Multiple Listing Service® and the associated logos are owned by The Canadian Real Estate Association (CREA) and identify the quality of services provided by real estate professionals who are members of CREA. CREA’s member brokerages are responsible for the listing information, and CREA assumes no responsibility for its accuracy.

6a. Security

For your security and as the PropTx rules require, you are signed out after 60 minutes without activity, and access pauses for 24 hours if an unusually high number of sold or leased listings is opened from one account. We send you an email confirming each time you accept these Terms of Use.

7. Records and privacy

We keep a record of your name, email address, when you accepted these terms (and which version), and which sold or leased listings you viewed. We keep these records for at least 180 days after your access lapses, and we may share them with PropTx or TRREB on request for auditing, to investigate suspected misuse, or as the law requires. 8. Ending access

You may stop using the VOW at any time and ask us to close your account (data deletion), subject to the record keeping above. We may suspend or end your access at any time, for example if these terms are breached or if our MLS® data licence requires it.

9. Changes and contact
